GSCaddie — Terms of Service

These Terms of Service ("Terms") govern your access to and use of GSCaddie, a Windows desktop companion application and associated web dashboard ("GSCaddie," "we," "our," or "us") operated by M5 Software Solutions LLC. By installing, accessing, or using GSCaddie, you agree to these Terms. If you do not agree, do not install or use GSCaddie.
1. What GSCaddie is
GSCaddie is an independent, third-party companion tool for users of the GSPro golf simulator software. It helps you analyze your own shot data, review rounds, surface trends across rounds, and get drills built around the patterns it finds in your game.
1.1 No affiliation with GSPro
GSCaddie is not affiliated with, endorsed by, sponsored by, or in any way officially connected with GS-Pro, the developers of GSPro, or any of their parent companies, subsidiaries, or affiliates. "GSPro" and any related names, marks, emblems, and images are registered trademarks of their respective owners.
GSCaddie runs entirely on your own computer and reads only files that GSPro and/or your launch monitor software write to your local disk during normal use.
1.2 Your data belongs to you
The shot and round data that GSCaddie reads is your data. It is generated by your swing, measured by your launch monitor hardware, and written to your computer's local disk. GSPro is the simulator that receives that measurement data from your launch monitor, applies its physics engine, and displays a result — but the underlying performance data (ball speed, launch angle, spin, carry distance, club used, result coordinates, score, etc.) describes your athletic performance on your equipment.
GSCaddie operates on this premise:
- We only read data that you own — your own performance metrics, on your own machine.
- We do not read, copy, or transmit any GSPro-authored intellectual property (course files, course graphics, course geometry, proprietary UI assets, encrypted round blobs, etc.).
- We do not decrypt, bypass, or otherwise circumvent any protection GSPro has placed on its own content.
- We do not interact with GSPro's servers, scrape its portal, or ingest community-uploaded course content.
If a piece of data is encrypted, locked, or otherwise protected by GSPro, we treat that as a signal GSPro considers it theirs, and we leave it alone. If a piece of data is plainly written to your disk in an unprotected form (a log line describing your shot, an unencrypted metrics row, an API payload from your launch monitor), we treat it as yours to read.
2. What GSCaddie does NOT do
To eliminate ambiguity about how GSCaddie interacts with GSPro and your launch monitor, we explicitly disclaim the following behaviors. GSCaddie does not:
- Modify, patch, or alter GSPro or any GSPro executable, DLL, configuration file, course file, or installation directory in any way.
- Decompile, disassemble, reverse engineer, or derive source code from GSPro, any GSPro component, any launch monitor software, or any associated binary.
- Decrypt any encrypted data produced or stored by GSPro, including but not limited to encrypted columns in GSPro's local database (e.g.,
RoundData,RoundSettings). - Intercept, proxy, redirect, or man-in-the-middle any network traffic between GSPro, your launch monitor, GSPro's servers, or any third-party service.
- Inject code, hook APIs, or attach as a debugger to the GSPro process or any launch monitor process.
- Automate, simulate, script, or spoof shot input to GSPro. GSCaddie is strictly passive: it reads data after you have played each shot; it never sends data into GSPro.
- Collect, copy, or redistribute GSPro-authored intellectual property, including course files, course geometry, course graphics, course metadata, GSPro UI assets, or community-uploaded course content.
- Act as a cheat, hack, mod, or competitive-advantage tool inside GSPro. GSCaddie does not alter gameplay, physics, scoring, or results.
- Bypass, circumvent, or interfere with any license check, subscription check, or digital-rights mechanism of GSPro or any launch monitor vendor.
- Scrape GSPro's web portal, community site, or servers. GSCaddie only reads data from your own local filesystem and, where available, from the documented GSPro OpenAPI (GSProConnect).
GSCaddie's sole data sources are:
- Files that GSPro and/or your launch monitor write to your local disk in their normal course of operation (for example, diagnostic log files, the shot/round SQLite database, and the current-round working file).
- Optionally, the documented GSPro OpenAPI (GSProConnect) if you enable it.
- Data you voluntarily enter into GSCaddie (account details, notes, handicap, club assignments, etc.).
3. Your responsibility to comply with third-party agreements
You are solely responsible for complying with the terms of service, end-user license agreements, and privacy policies of:
- GSPro (https://gsprogolf.com/terms-of-service.html)
- Your launch monitor vendor (e.g., Uneekor, Foresight, Flightscope, Garmin, Rapsodo, etc.)
- Any other third-party software or service you connect to GSCaddie.
You represent and warrant that your use of GSCaddie alongside these products does not violate any agreement you have with those vendors. If a third-party agreement you are subject to prohibits companion tools of this nature, you must not use GSCaddie.
4. License grant
Subject to your compliance with these Terms and, where applicable, your payment of subscription fees, M5 Software Solutions LLC grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use GSCaddie on computers you own or control, solely for your personal, non-commercial golf practice and analysis.
4.1 Restrictions
You may not, and may not permit any third party to:
- Copy, modify, adapt, translate, or create derivative works of GSCaddie;
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of GSCaddie, except to the extent such restriction is prohibited by applicable law;
- Sell, rent, lease, sublicense, distribute, or commercially exploit GSCaddie;
- Remove or obscure any proprietary notices;
- Use GSCaddie to build a competing product;
- Use GSCaddie in any manner that violates applicable law or any third-party right;
- Share, transfer, or resell your GSCaddie account or subscription.
5. Accounts and subscriptions
5.1 Account registration
To use the online/sync features, you must create an account with accurate information and keep your credentials secure. You are responsible for all activity under your account.
5.2 Subscriptions, billing, and refunds
Certain features require a paid subscription. Pricing, billing interval, and renewal terms are disclosed at the point of purchase. Subscriptions renew automatically until canceled. You may cancel at any time; cancellation stops future renewals and takes effect at the end of the current billing period. Refund eligibility is described at purchase and is otherwise at our sole discretion, except where required by law.
5.3 Changes to pricing
We may change pricing for future billing periods with reasonable advance notice. Continued use after the effective date constitutes acceptance.
6. Acceptable use
You agree not to:
- Use GSCaddie in violation of any law, regulation, or third-party right;
- Use GSCaddie to infringe intellectual property rights, including those of GS-Pro or any launch monitor vendor;
- Attempt to gain unauthorized access to GSCaddie systems, accounts, or data;
- Interfere with, overload, or disrupt GSCaddie servers or networks;
- Upload malware, or content that is unlawful, defamatory, or harmful;
- Use GSCaddie to compete in sanctioned tournaments in any manner that violates the tournament's rules.
7. Your data
You own your shot, round, and performance data. It is generated by your swing, captured by your hardware, and stored on your computer. GSCaddie is a tool that helps you read, analyze, and sync your own data. You retain all rights to it.
Our handling of that data is described in the Privacy Policy, which is incorporated into these Terms by reference.
You grant us a limited, worldwide, non-exclusive, royalty-free license to host, process, transmit, back up, and display your data solely as necessary to provide and improve GSCaddie to you. This license ends when you delete your data or close your account (subject to the retention rules in the Privacy Policy).
8. Analytics, drills, and recommendations
GSCaddie analyzes your shot data and produces aggregate metrics, derived statistics, and rule-based drill recommendations (for example, dispersion ellipses, strokes-gained breakdowns, shape classification, gap detection, drill suggestions targeted at observed faults). These outputs are computed from your own data and may be incorrect, incomplete, or misleading. They are not coaching advice, medical advice, or professional instruction. Use your own judgment. You are responsible for how you act on them.
9. Intellectual property
GSCaddie, including its code, UI, graphics, trademarks, and documentation, is owned by M5 Software Solutions LLC and its licensors and is protected by copyright, trademark, and other laws. These Terms do not grant you any rights to our trademarks or branding.
We respect the intellectual property of others. If you believe content in GSCaddie infringes your copyright, contact hello@gscaddie.com with a DMCA-compliant notice.
10. Third-party services
GSCaddie interoperates with third-party services (e.g., your GSPro installation, your launch monitor software, our cloud provider, payment processors). We are not responsible for those services. Your use of them is governed by their respective terms.
11. Disclaimers
GSCaddie IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT GSCADDIE WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, OR COMPATIBLE WITH ANY PARTICULAR GSPRO VERSION, LAUNCH MONITOR, OR OPERATING SYSTEM CONFIGURATION. GSPRO AND LAUNCH MONITOR FILE FORMATS MAY CHANGE WITHOUT NOTICE, WHICH MAY TEMPORARILY OR PERMANENTLY BREAK GSCADDIE FEATURES.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL M5 Software Solutions LLC, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF GSCADDIE.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR GSCADDIE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the fullest extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless M5 Software Solutions LLC from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of (a) your violation of these Terms, (b) your violation of any third-party right or agreement (including the GSPro ToS or your launch monitor vendor's ToS), or (c) your misuse of GSCaddie.
14. Termination
We may suspend or terminate your access to GSCaddie at any time, with or without notice, for any violation of these Terms or if required by law or business necessity. You may stop using GSCaddie at any time. Sections that by their nature should survive termination (e.g., IP, disclaimers, limitation of liability, indemnification, governing law) survive.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced via the app, the website, or email. Your continued use of GSCaddie after the effective date of updated Terms constitutes acceptance.
16. Governing law and disputes
These Terms are governed by the laws of the State of Connecticut, USA, without regard to its conflict-of-laws rules. Any dispute shall be resolved exclusively in the state or federal courts located in the State of Connecticut, and you consent to personal jurisdiction there. You and we each waive any right to a jury trial and to participate in a class action, to the extent permitted by law.
